Software as a Service (SaaS) Agreement

(Briefs Encountered Pro, Briefs Encountered Lite & Medically Briefed Web)


USE OF THE SERVICE IS SUBJECT TO THE TERMS SET FORTH BELOW. USING THE SERVICE INDICATES YOUR ACCEPTANCE OF THESE TERMS.

During the term of this Agreement, Customer may access and use White-Boucke Productions’ Briefs Encountered Pro, Briefs Encountered Lite or Medically Briefed Web cloud computing products (the Service) -- as purchased -- pursuant to Vendor’s policies posted below:
 
  • Customer may not transfer access and use of the Service to any other person at any time.
  • Customer will not access or utilize, from more than 2 (two) devices concurrently, or through more than 2 (two) concurrent connections on a single device.
  • Customer accepts responsibility for breach of policy consequences if others access or utilize the Service using customer's login credentials.
White-Boucke Productions retains all right, title, and interest in and to the Service, including without limitation all software used to provide the Service and all logos and trademarks reproduced through the service. This Agreement does not grant customer any intellectual property rights in the Service or any of its components.

The Service is a “commercial item,” as that term is defined in 48 C.F.R. 2.101, involving “commercial computer Software” and “commercial computer Software documentation,” as such terms are used in 48 C.F.R. 12.212. Consistent with 48 C.F.R. 12.212 and 48 C.F.R. 227.7202-1 through 227.7202-4, all U.S. Government End Users make use of the Service with only those rights set forth herein.

Software License Agreement

(Legacy Software - Briefs Encountered V.4 & Medically Briefed V.4)


USE OF THE SOFTWARE IS SUBJECT TO THE LICENSE TERMS SET FORTH BELOW. USING THE SOFTWARE INDICATES YOUR ACCEPTANCE OF THESE LICENSE TERMS. IF YOU DO NOT ACCEPT THE TERMS, YOU MAY RETURN THE SOFTWARE FOR A FULL REFUND.

White-Boucke Productions grants Customer a license to use one copy of the Software on a desktop PC plus one copy of the Software on a laptop PC, provided both computers are owned and exclusively operated by the licensee. “Use” means storing, loading, installing, executing or displaying the Software. “Software” means the digital computer files contained on the original CD-ROM and installed on a Windows-based computer, including all application, search engine and dictionary data files. Customer may not modify the Software or disable any licensing or control features of the Software. The additional items contained on the CD-ROM, described in the User’s Guide as “Disk Extras” may be freely copied and distributed.

The Software is owned and copyrighted by White-Boucke Productions. Your license confers no title or ownership in the Software and is not a sale of any rights in the Software. You may only make copies or adaptations of the Software for archival purposes or when copying or adaptation is an essential step in the authorized use of the Software. You must reproduce all copyright notices in the original Software on all copies or adaptations. You may not copy the Software onto any bulletin board, Internet website or similar system.

The Software, as supplied, is protected by an installation key-lock algorithm that can only be decoded by White-Boucke Productions upon initial installation and on reinstallation following hard disk reformatting. Your license confers a maximum of 8 “unlocks” for each serial-numbered copy of the Software. You may not disassemble or decompile the Software unless White-Boucke’s prior written consent is obtained. You may not decrypt the Software unless decryption is a necessary part of the operation of the Software.

Your license will automatically terminate upon any transfer of the Software. Upon transfer, you must “unregister” and uninstall the Software on your computer(s) and deliver the original Software, including related documentation and packaging, to the transferee. The transferee must accept this Software License Agreement as a condition to the transfer. You must make clear to the transferee that each serial-numbered copy of this software can only be installed and unlocked 8 (eight) times and advise the transferee as to how many times the software has been reinstalled and unlocked.

White-Boucke Productions may terminate your license upon notice for failure to comply with any of these license terms. Upon termination, you must immediately destroy the Software, together with all copies adaptations and merged portions in any form.

You may not export or reexport the Software or any copy or adaptation in violation of any applicable laws or regulations. U.S. Government End Users. The Software is a “commercial item,” as that term is defined in 48 C.F.R. 2.101 (October. 1995), consisting of “commercial computer Software” and “commercial computer Software documentation,” as such terms are used in 48 C.F.R. 12.212 (September. 1995). Consistent with 48 C.F.R. 12.212 and 48 C.F.R. 227.7202-1 through 227.7202-4 (June 1995), all U.S. Government End Users acquire the Software with only those rights set forth herein.

White-Boucke only uses personal information for specific purposes. The information you provide will be kept confidential and will be used to process your order, gain access to restricted areas of the BouckeBriefs website, or to support your relationship with White-Boucke Productions. White-Boucke will not disclose your personal information to any outside organization for its use in marketing. Information regarding you (such as name, address and phone number) or your order and the products you purchase will not be given or sold to any organization for its use in marketing or solicitation at any time.

Internet Commerce
White-Boucke is committed to data security with respect to information collected on our site. Only our e-commerce service provider has knowledge of your purchasing method. Transaction information is passed directly from you to the e-commerce service provider and is not captured by White-Boucke Productions. It is our policy to contact customers only in the event of a potential problem with your purchase or any normal business communication regarding your purchase.

Non-Customized Experience
We do not use "cookies" to collect information about your computer or its hardware or software. We choose not to use this technology so that we only know information about you that you have provided voluntarily. We cannot determine what type of computer you are using, or what kind of components you may have. White-Boucke has no desire or intent to infringe on your privacy while using this web site.

What else should you know about your privacy?
Any third party, referenced or linked Internet sites and services accessible through BouckeBriefs.com have their own, separate privacy and data collection practices, independent of White-Boucke. We have no responsibility or liability for these independent policies or actions. You are solely responsible for maintaining the secrecy of your passwords or any account information. Please be careful and responsible whenever you're visiting any Internet site. If you post personal information online that is accessible to the public, you may receive unsolicited messages from other parties in return. While White-Boucke strives to protect your personal information, we cannot ensure or warrant the security of any information you transmit by modem, e-mail or web site access and you do so at your own risk.

White-Boucke Productions Returns Policy

All sales are final. White-Boucke does not accept merchandise returns except in the case of:
 
  • Incorrect item(s) shipped.
  • Defective product/shipping damage, i.e.
    • Books - faulty binding, loose pages, incorrectly printed pages, or missing pages.
    • Computer Software - damaged disk, failure to install.
Report problems by e-mail within one week of receipt of goods. In most cases, the customer will be asked to return the subject merchandise to us. On receipt, we will either replace the returned item with a fully functional replacement item or refund the original purchase price less the shipping charge.
No exchange or refund will be given if returned item(s) show signs of improper use, operational wear or damage on route to us due to improper packing.

DISCLAIMER - There are no other remedies, either expressed or implied, which extend the foregoing, and there are no warranties of merchantability or fitness for any particular purpose. We will not be responsible for incidental or consequential damage due to defective, or improper use of, products. The foregoing shall be the exclusive remedy for defective or nonconforming merchandise.

White-Boucke Productions Shipping Policy

  • Standard Shipping・ is our default method of fulfilling domestic orders (including military APO addresses). Standard Shipping・ is either USPS First Class Mail or USPS Media Mail, at the discretion of White-Boucke Productions. Transit time for Standard Shipping・ in the contiguous 48 States is typically 3-5 business days.
  • Customers may upgrade to an expedited means (next-day air, express mail, priority mail, etc) or specify a particular carrier (e.g. FedEx). In this regard, customers should contact White-Boucke Productions by e-mail or telephone (559) 641-5444 to place the order, since these options involve increased shipping charges and possible expedite fees.
  • White-Boucke is not responsible for items lost or stolen once they have been accepted by the carrier. Customers who want to purchase insurance for shipping should contact us at (559) 641-5444 before placing an order. We record tracking numbers for all packages shipped in the USA.
  • Any shipped products that are returned to us by the carrier as “undeliverable items” due to an incorrect address being furnished by the customer will be returned to inventory unless the customer pays for the product(s) to be re-shipped to the correct address. If an order is undeliverable due to a labeling error by White-Boucke, the package will be re-shipped at no charge to the customer.

Such flow depends in large part on the performance of Internet services provided or controlled by third parties. Actions or inactions of such third parties can impair or disrupt your connections to the Internet (or portions thereof). We cannot guarantee that such events will not occur.
